FACTS: Plaintiff nightclub patron was assaulted by a fellow patron about two blocks away from the club property. Plaintiff claimed that the assault began on the club premises with an altercation involving club staff and other patrons, and then he was followed and attacked off the premises. Plaintiff maintained the club had a duty to protect him from the attack since it began on the premises and continued off the premises with the knowledge of the club.
DISPOSITION: A motion for summary judgment was brought on behalf of the club which the trial court granted. Plaintiff appealed. The firm handled the appeal and prevailed. The appellate court agreed with the argument that a business owner’s duty to its patrons does not extend so far off its premises.
